How do I make a claim?

Making a claim can be complicated and in some instances, strict time limits apply. 

We strongly recommend you get in touch with our office promptly so we can investigate your claim and protect your rights.

Are there time limits?

Yes.  In most cases strict time limits apply.  

It is very important you contact us for independent legal advice at the earliest opportunity after your incident/injury to ensure your rights are protected.

If I don’t go ahead with my claim – will you charge me?

No, we are no win no fee lawyers.  

Your first consultation is free and if you do not proceed with the claim, there is no charge.

Do you take on every case?

No, we make our judgement on a case by case basis and if we think the chances of a successful claim are low, we will say so.

How will I pay the legal fees?

Premier Lawyers no win no fee guarantee is generally available for all types of personal injury claims.  

This means you do not pay for our professional fees unless your case is successful. In addition, if your case is successful the insurance company usually covers a portion of the legal costs.

How will you advise me?

At Premier Compensation Lawyers we are more than happy to provide you with a free initial advice over the phone.  

If it is convenient, we can then arrange an appointment to see you. We understand that it may be difficult for you to travel and we are always happy to arrange a home visit.

Will I have to go to court?

Most cases do not end up going to court.  Both workers compensation and motor accident claims go through an alternate dispute resolution process which is designed to resolve a case by agreement so that a court hearing is not necessary.  

We estimate that 90% of cases are settled without the need for a court hearing, giving you fast results and reducing the stress on you and your family.

Our costs

This is to help you understand how legal costs are charged.  We provide you with the following information:

  • We will give you advice and the value of your claim before you are asked to respond to any offer of settlement. 
  • We will inform you of any offers made in your claim, including any offer to pay your legal costs. 
  • We will provide you with an account of all amounts that will be deducted from settlement offers.
  • When your claim is finalised we require your approval before we deduct legal costs as agreed.  We do not accept payment of our legal costs until you have approved our bill.
